Event Participation Agreement and Terms and Conditions

Forth Bridge Abseil Event – Participation Agreement

Please read this agreement carefully before participating in the abseiling event. This agreement is governed by Scottish law and sets out the terms and conditions under which you agree to participate in the abseiling event. The technical abseil elements of this event, including safety equipment fitting and removal, access and egress from the bridge and the abseil itself are delivered to you by Zone Events Limited on behalf of and contracted by the event owner, Chest Heart & Stroke Scotland. Zone Events Limited is a company incorporated under the Companies Acts (Registered No. SC595805). By participating in the event, you acknowledge and accept these terms and conditions. If you do not agree with any part of this disclaimer, please do not take part in the event.

Nature of the Event: You knowingly and freely assume and accept all such risks, both known and unknown, and take full responsibility for your participation in the Event. You have familiarized yourself with the elements of the Event shown on the event website/online booking and/or in the description below:

The Abseil is designed to be a physical and mental challenge whereby you will abseil (descend) down a rope from height using our climbing equipment as instructed by our staff. The Abseil may be held in adverse weather conditions such as snow, wind, ice, fog, humidity and rain.

Assumption of Risk: Abseiling is an inherently risky activity, and by participating in this event, you acknowledge and accept the potential dangers and risks involved. You understand that there is a risk of injury, including serious injury or even death, and you voluntarily assume all such risks.

To the extent permitted by law, the Participant (You) accepts and shall not make any claim or demand against Chest Heart & Stroke Scotland, its employees or agents for any reason whatsoever including, but not limited to, any claim or demand arising as a result of any action, default, commission or negligence of Chest Heart & Stroke Scotland, its employees or agents, and to the fullest extent permitted by law the Participant (You) accepts that Chest Heart & Stroke Scotland, its employees or agents will not be liable for any loss, damage, action, claim, costs or expenses, which may arise in consequence of participation in the event.

The Participant (You) must comply with all laws in force for the time being and must indemnify and keep indemnified against any claim or demand arising out of a breach or alleged breach of any law by a Participant.

Physical Fitness and Health: You affirm that you have no medical conditions that would prevent you from safely participating in the abseiling event. If you have any doubts about your physical fitness or health, it is your responsibility to consult with a qualified medical professional before taking part.

Medical Treatment: You have submitted true and accurate information of your medical history and present condition that may affect your participation or medical treatment in any part of the Event. In the event of a medical emergency whilst taking part in this event, you hereby give permission to our staff to initiate first aid treatment, any necessary medical transportation and to inform your emergency contact.

Qualified Instructors and Equipment: The abseil will be led by qualified and experienced instructors who will provide necessary guidance and instructions. You agree to follow their directions at all times. The event organizers will provide appropriate abseiling equipment, which you agree to use in accordance with the instructions provided.

Personal Belongings: You are responsible for your personal belongings during the event. The event organizers and instructors will not be held liable for any loss, theft, or damage to personal property.

Release of Liability: To the fullest extent permitted by Scottish law, you hereby release, discharge, and hold harmless Chest Heart & Stroke Scotland, Zone Events Limited, and their respective directors, officers, employees, agents, contractors, and their respective agents, from any and all liability, claims, demands, actions, or causes of action arising out of or related to your participation in the abseiling event, including but not limited to personal injury, property damage, or death.

Compliance with Laws and Regulations: You agree to comply with all applicable laws, regulations, and guidelines while participating in the abseiling event, including but not limited to any safety instructions or rules provided by the event organisers.

Photography and Media: By participating in the event, you grant Chest Heart & Stroke Scotland and Zone Events Limited the right to use any photographs, videos, or other media taken during the event for promotional and marketing purposes, both online and offline, including but not limited to social media, websites, print materials, and advertisements, without compensation or further consent. You acknowledge that these materials may be shared with third parties for promotional purposes related to the abseiling event. If you do not want your image taken please inform our staff before taking part.

The Participant (You) understands that photographs are taken by Chest Heart & Stroke Scotland and employees at our Events and you grant permission to Chest Heart & Stroke Scotland, its employees and agents to use photographs, motion pictures, recordings, data or any other record of your Participation in this event for any legitimate purpose without remuneration. If you would like any photograph deleted from any CHSS medium you can contact the CHSS team at [email protected] We will never link, identify, disclose, or match your name to an image or film you may be present without first seeking your permission. Permission will first be sought for any specific public use of an individual’s photograph.

Age Restrictions: You must be at least 18 years of age on the date of the event.

Equipment Limitations: We regret that beyond the following body sizes and weight we are unable to provide the required equipment to allow your participation.

Minimum Height – 140cm high
Maximum Height – 200cm
Maximum Waist – 120cm
Maximum Thigh – 75cm
Helmet Size: Head circumference: 48-61 cm

Maximum Weight: 18 Stone / 114.3kg

Rules of participation summary:
You must always listen carefully and follow all instructions from the staff
Do NOT adjust or remove the harness or helmet once fitted
STRICTLY no phones or loose items are allowed to be carried
STRICTLY No smoking or vaping
Long Hair must be tied up
No necklaces, chains or loose jewellery
Shoes must be laced up tight. No slippers or loose-fitting shoes
No Hoodies or shorts
All glasses and eyewear must have a banded strap so that they are securely on you and cannot fall off, otherwise they must be removed
If you have any concerns please inform a member of our staff immediately
We recommend you bring leather gardening style gloves (if you have), if not we will provide gloves for you

Disabilities & Pre-existing Medical Conditions Should you have any disabilities or pre-existing medical conditions which may affect your ability to complete this event safely then please let us know asap.

Event Cancellations or Postponements: We reserve the right to cancel or postpone the event if we consider there is an unacceptable risk (e.g. severe adverse weather) to the event participants, our staff or the general public.

I accept no refund will be given if I cannot attend or if the event is cancelled for any reason. All entry proceeds will go to support the work of Chest Heart & Stroke Scotland. You agree to be bound by all the event rules, conditions, and safety instructions.

You are the person named on this form and will not give your place to anyone else, pretend to be anyone else or swap any participant identification methods during the Event.

Severability: If any provision of this disclaimer is found to be invalid or unenforceable under Scottish law, the remaining provisions shall remain in full force and effect.

Data Protection: We will use your data to provide you with important and relevant information regarding the event, to support you in your fundraising, and provide the services and experiences that are fundamental to your safe and enjoyable participation in the event. We will never sell your personal information to third party organisations. More information about how we protect and use your data can be found on our website in our privacy policy.
